The woman who sued JAY-Z for alleged sexual assault is trying to get a judge to toss out the lawsuit against her.
According to a report TMZ published on Tuesday, April 22, the Alabama resident, who claimed the rapper and Sean "Diddy" Combs raped her when she was 13, filed a motion to dismiss the defamation lawsuit JAY-Z filed against her and her attorney Tony Buzbee. She told a judge that Hov can't sue her because she made her allegations in court documents, which she claimed were privileged at the time. She also asserted she can't be sued over her NBC News interview because her statements were based on the claims listed in legal documents.
Jane Doe initially named JAY-Z, born Shawn Carter, in her sexual assault lawsuit several months after she filed the original case against Combs last October. In her lawsuit, Doe claimed JAY-Z and Diddy raped her at an after-party for the MTV Video Music Awards in 2000. Mr. Carter's attorneys instantly denied the allegations and alleged it was a "blackmail attempt." After acknowledging several holes in her story, Doe eventually dropped the lawsuit. JAY-Z responded by filing a defamation lawsuit against her and Buzbee.
Buzbee tried to get the lawsuit against him dismissed earlier this month. He claimed there was a deal in place, but it fell apart because JAY-Z and his lawyers backed out. Hov's attorney Alex Spiro denied Buzbee's claims and said it was "a total lie."
As of this report, JAY-Z's lawyers haven't responded to Jane Doe's recent motion.
